Be ready before an inspection or complaint
Knowing your obligations helps you act before a spill becomes a compliance problem. Regulation (EU) 2025/2365 provides for unannounced inspections and substantiated complaints from eligible third parties. It also requires records of annual estimated losses and quantities handled, and notification of non-compliance to the competent authority. Annual internal assessments are mandatory for medium-sized and large enterprises at installations handling at least 1,500 tonnes in the previous year.
For the most serious infringements by legal persons, national law must provide a maximum administrative financial penalty of at least 3% of annual EU turnover. This is a requirement for the maximum penalty, not an automatic fine for every incident. Most provisions apply from 17 December 2027; the general duty to prevent losses and act immediately when losses occur has applied since 16 December 2025. The course explains the dates, scope and responsibilities relevant to your role. Source: Regulation (EU) 2025/2365, Articles 3, 5, 13, 15, 19, 20 and 26.
